1. Acceptance and Scope
These Terms of Service (the “Terms”) form an agreement between you and IvyVina Pageants (“IvyVina,” “we,” “us,” or “our”) concerning the IvyVina website, public pages, dashboards, voting tools, payment flows, communications, and related services (collectively, the “Service”).
You accept these Terms by using the Service or selecting an agreement checkbox. If you use IvyVina for an organization, pageant, school, agency, or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
2. Eligibility and Authority
You must be legally capable of entering a binding agreement in your location. A person under the age of legal majority may use the Service only with the involvement and permission of a parent or legal guardian. A person making a paid purchase represents that they are authorized to use the selected payment method.
IvyVina is not intended to let children create independent accounts or make purchases without appropriate adult involvement. Additional pageant-specific age or geographic restrictions may also apply.
3. IvyVina’s Role
IvyVina provides technology for pageant creation, contestant presentation, voting, payment recording, reporting, and winner publication. Unless IvyVina expressly identifies itself as the organizer of a particular pageant, the organizer—not IvyVina—creates and administers the competition.
Organizers control their pageant eligibility, judging criteria, schedules, contestant acceptance, tie-breaking rules, and official winner decisions. IvyVina may provide calculated rankings and administrative tools, but does not independently certify the fairness, legality, or outcome of an organizer-run pageant.
4. Accounts and Security
Access differs by role. Organizers may manage their own pageants, contestants, votes, and orders; voters may view their own voting and purchase history; administrators may manage platform-wide operations and integrity.
- Provide accurate, current, and complete registration, organizer, voter, and transaction information.
- Keep passwords, verification links, and account access confidential and use a unique password.
- Do not share an account in a way that defeats role permissions or allows unauthorized administration.
- Notify IvyVina promptly if you suspect unauthorized access, fraudulent voting, or account misuse.
- Accept responsibility for activity performed through your account unless applicable law provides otherwise.
5. Organizer Responsibilities
An organizer is responsible for the pageant and all information, media, rules, and decisions submitted through its account. Creating a pageant confirms the organizer is authorized to operate and publish it.
- Publish accurate pageant names, descriptions, schedules, voting periods, venue information, eligibility rules, and winner details.
- Obtain all contestant, photographer, copyright, trademark, publicity, privacy, and guardian permissions required for submitted content.
- Maintain fair and lawful pageant rules and disclose material rules to contestants and voters.
- Review pageant dates, timezone, voting configuration, contestant status, and tie-breaking method before launch.
- Respond appropriately to contestant, parent or guardian, and voter concerns involving organizer-controlled information.
- Comply with applicable promotion, competition, consumer, tax, advertising, privacy, child-protection, and accessibility laws.
6. Contestants and Minors
Organizers must have permission from each contestant to create and publish a profile. If a contestant is a minor, the organizer must obtain legally sufficient permission from a parent or legal guardian before submitting or publishing the minor’s name, age, images, biography, location, social links, or other personal information.
The organizer must provide guardian information and confirm guardian consent where IvyVina requests it. IvyVina may require evidence of authorization, limit public fields, unpublish a profile, or remove content when consent is disputed or safety concerns arise.
7. User Content and Permissions
You retain ownership of content you submit. You grant IvyVina a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, display, distribute, and otherwise use that content only as reasonably needed to operate, secure, promote, and improve the Service and the pageant you chose to publish. This license ends when content is deleted from active systems, subject to reasonable backups, legal retention, and content already shared by others.
You represent that your content is accurate, lawful, does not violate another person’s intellectual property, privacy, publicity, contractual, or other rights, and does not include unnecessary sensitive information. IvyVina may reject, restrict, or remove content that violates these Terms or creates legal, safety, or integrity risk.
8. IvyVina Intellectual Property
The Service, excluding user content, including IvyVina’s name, logos, interface, software, graphics, documentation, and original materials, is owned by IvyVina or its licensors and protected by applicable intellectual property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose; they do not transfer ownership.
9. Pageant Publication and Lifecycle
Draft pageants are available to their signed-in owners for preview but are not eligible for general public discovery. Publishing makes pageant information and published contestant profiles publicly accessible. Pageant status may move through upcoming, live, voting closed, and completed stages according to configured dates and organizer actions.
Editing or lifecycle actions may be limited after voting closes, a winner is published, or a pageant ends in order to preserve records and result integrity. IvyVina may correct status inconsistencies caused by schedule changes or technical errors.
10. Free and Paid Voting
- IvyVina allows one free vote per valid email address, per pageant, per calendar day based on the pageant timezone.
- Additional votes may be purchased using the packages and prices displayed at checkout. Displayed prices are in the stated currency, currently USD unless shown otherwise.
- A vote is not guaranteed until IvyVina validates the request and, for paid votes, receives confirmed payment status from the payment provider.
- Authorized IvyVina administrators may record legitimate sponsorship votes before voting or the pageant ends. Organizers may review sponsorship records for their pageants but cannot create them. These votes affect totals and rankings, are not customer purchases or payment revenue, are kept in a separate audit ledger, and are publicly identified as Sponsorship support.
- Users may not automate voting, use false or disposable identities to evade limits, coordinate chargeback abuse, exploit software defects, or otherwise manipulate results.
- Internet interruptions, duplicate submissions, provider delays, and security review may delay a vote or order from appearing.
11. Payments and PayPal Checkout
Paid vote purchases are processed through the payment provider identified at checkout, initially PayPal. The provider may collect payment credentials under its own terms and privacy policy. IvyVina does not receive or store your PayPal password or full payment-card number.
Submitting checkout authorizes the displayed charge. A new order may remain pending until the provider confirms the amount, currency, recipient, and transaction reference. IvyVina credits paid votes only after successful verification and may withhold or reverse credit if a transaction is denied, duplicated, reversed, refunded, disputed, or reasonably suspected of fraud.
You are responsible for provider fees, currency-conversion costs, taxes, or bank charges disclosed by the provider or required by law. Keep the IvyVina order number and PayPal receipt for support requests.
12. Refunds, Reversals, and Chargebacks
Except where required by law or expressly stated at checkout, completed vote purchases are final and non-refundable after votes are credited because they provide immediate digital support that can affect live rankings. A cancelled, abandoned, or unconfirmed checkout does not add paid votes.
If you believe a charge is unauthorized, duplicated, incorrect, or was not credited, contact IvyVina with the order number before initiating a provider dispute when reasonably possible. Approved refunds, payment reversals, or successful chargebacks may result in the associated votes being removed and rankings being recalculated.
Nothing in these Terms limits a non-waivable consumer right or a payment-provider protection that applies to you.
13. Voting Integrity and Enforcement
IvyVina may use email, session, IP address, device or browser signals, transaction references, timing, volume patterns, and manual review to enforce voting limits and protect the Service. We may delay, reject, quarantine, remove, or reverse votes and suspend related accounts or pageants when activity appears automated, fraudulent, abusive, duplicated, unauthorized, or contrary to published rules.
Sponsorship votes must represent disclosed sponsorship support and may be entered only by an authorized IvyVina administrator before the applicable closing time. IvyVina records their public attribution, vote quantity, recorder, time, and reference so they are distinguishable from voter purchases and free votes.
Integrity controls are imperfect and may produce false positives. Users may contact support with an order number or relevant evidence for review. IvyVina’s platform-integrity decision does not replace an organizer’s separate responsibility for official pageant decisions.
14. Rankings, Ties, and Winners
Displayed totals and rankings are provisional until voting closes, relevant payments are verified, suspicious activity is reviewed, and the organizer confirms the result. Totals may change because of delayed payment confirmation, refunds, reversals, corrections, or removed votes.
The organizer is responsible for applying the pageant’s tie-breaking method and selecting the official winner. IvyVina may preserve an audit trail and require confirmation before publishing a winner, but does not guarantee that the contestant with the temporarily displayed highest total will be declared the winner.
15. Prohibited Conduct
- Break the law, facilitate deception, impersonate another person, or misrepresent authority to operate a pageant.
- Harass, exploit, sexualize, threaten, defame, or expose private information about contestants, voters, organizers, or minors.
- Upload malware, malicious code, illegal content, or content that infringes another person’s rights.
- Probe, bypass, disable, or interfere with authentication, payment verification, voting limits, security, or availability.
- Scrape, harvest, sell, or use personal information from the Service without a lawful basis and authorization.
- Reverse engineer or copy the Service except where a non-waivable law permits it.
- Use bots, scripts, account farms, coordinated payment disputes, or other methods to distort voting or analytics.
16. Third-Party Services
The Service may link to or rely on PayPal, email delivery, hosting, analytics, social media, and other third-party services. Their terms and privacy practices govern your direct interaction with them. IvyVina is not responsible for a third party’s independent service, availability, content, or acts, but will use reasonable care in selecting providers that support the Service.
17. Privacy and Communications
Our Privacy Policy explains how IvyVina handles personal information and is incorporated into these Terms by reference. You agree to receive service messages needed for accounts, security, votes, orders, pageant administration, and policy changes. Where required, marketing communications will be optional and include a way to unsubscribe.
18. Suspension, Termination, and Account Deletion
You may stop using the Service and may request account deletion through available account tools. IvyVina may restrict, suspend, or terminate access, unpublish content, pause voting, or hold an order for review when reasonably necessary to address Terms violations, security threats, legal requests, payment risk, harm, or platform integrity.
Sections that by their nature should survive termination remain effective, including payment obligations, intellectual property, content permissions needed for retained records, disclaimers, liability limits, indemnity, disputes, and lawful retention. Account deletion does not require deletion of records that must be retained for fraud prevention, transaction reconciliation, legal compliance, disputes, or enforcement.
19. Service Availability and Changes
IvyVina may add, change, pause, or discontinue features, payment providers, vote packages, eligibility controls, or Service components. We will make reasonable efforts to avoid materially disrupting active pageants and to provide notice when a change materially affects user rights or obligations.
The Service may be unavailable because of maintenance, provider outages, internet failures, emergencies, security events, or circumstances beyond reasonable control. IvyVina does not guarantee uninterrupted, error-free, or permanently available service.
20. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” IvyVina disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. We do not guarantee participation, votes, revenue, fundraising results, rankings, sponsorship, event success, or any particular pageant outcome.
Organizer content and pageant claims are supplied by organizers. IvyVina does not warrant that every organizer, contestant statement, pageant rule, external link, or public profile is complete, accurate, lawful, or current.
21. Limitation of Liability
To the fullest extent permitted by law, IvyVina and its owners, officers, personnel, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunity; pageant decisions; or unauthorized third-party conduct arising from or related to the Service.
To the fullest extent permitted by law, IvyVina’s aggregate liability for a claim will not exceed the greater of the amount you paid directly through IvyVina during the six months before the event giving rise to the claim or US $100. This limitation does not apply where liability cannot lawfully be excluded or limited.
22. Indemnification
To the extent permitted by law, organizers and other business users agree to defend, indemnify, and hold IvyVina harmless from third-party claims, losses, liabilities, and reasonable costs arising from their pageant, content, rules, contestant or guardian permissions, misuse of the Service, violation of these Terms, or infringement of another person’s rights. IvyVina will provide reasonable notice and may control the defense of a covered claim.
23. Governing Law and Disputes
Before filing a claim, contact IvyVina and provide a concise description of the issue and requested resolution so the parties can try in good faith to resolve it. This informal step does not prevent either party from seeking urgent injunctive relief or using a payment-provider dispute process where appropriate.
Unless mandatory law in your location requires otherwise, these Terms are governed by the laws of Jamaica, without regard to conflict-of-law principles, and the courts located in Kingston, Jamaica will have jurisdiction. Nothing in this section removes non-waivable consumer or data-protection rights.
24. Changes and General Terms
IvyVina may update these Terms. The updated version will show a new “Last updated” date, and we will provide additional notice when required by law or when changes materially reduce rights. Continued use after the effective date means you accept the revised Terms.
If any provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without IvyVina’s consent; IvyVina may assign them as part of a reorganization, financing, sale, or transfer of the Service. These Terms and incorporated policies are the entire agreement about the Service unless a separate written agreement applies.
